1. agree to be bound by, comply with and observe the Constitution of the ABPA (available via the ABPA) and any determinations or resolutions of the Board of the ABPA;
2. agree to pay the annual Membership Fee of the ABPA;
3. appoint the ABPA to be my bargaining representative in all negotiations relating to a collective agreement in respect of the employment of Players who participate in the NBL and WNBL Competition, and with the Clubs that operate Teams in the NBL or WNBL Competition, and/or who participate with a Team administered by Basketball Australia;
4. authorise the ABPA to act on my behalf in relation to matters that may affect my employment in the above mentioned Competitions, Leagues and Teams; and
5. authorise the NBL, Club and Basketball Australia to provide the ABPA with information relating to my employment, including, but not limited to a copy of my Contract and other registered agreements, copies of official notices (such as show cause and breach notices) of which I am the recipient, and copies of codes, policies and protocols which I am required to comply with in my employment; and
6. assign to ABPA the exclusive right to use and to grant to any persons (collectively “Licensees”) the right to use my name, nickname, signature facsimile, voice, picture, photograph, likeness, biographical information, playing statistics, and/or any other element associated with my identity (collectively “Image”) in group licensing programs for the period I am included as a player in the NBL or WNBL, and/or available for selection for an Australian National Team, provided that it does not conflict with a licensee of which I have notified ABPA. Group licensing programs are those in which a Licensee uses a total of three (3) or more basketball player images. In consideration for this assignment of right, ABPA will use the revenue it receives from group licensing programs to support the objectives as set out in the rules and regulations of the ABPA. This assignment will not be exercised in conflict with rights granted to an international player association, such as the NBPA.
